Status on the review of legislation impeding service delivery
The new bill is a result of a diagnostic analysis that emanated from the 2009 Local Government Turnaround Strategy (LGTAS) which was adopted by the Cabinet. As a way of giving effect to the LGTAS, the Ministry of Cooperative Governance and Traditional Affairs committed to expedite this process in its 2012 National Council of Provinces’ Budget Vote address.
Various sector departments from other spheres of government are involved in the drafting of the bill as the notion of service delivery embraces all functional apparatus within government.
The mandatory enforcement of cooperative governance requires the department to consult with sector departments for their necessary comments before the bill is tabled in Parliament.
Such consultation with affected sector departments is an on-going extensive process which can either provide for a regulatory framework approach or changes in the current legislation - this depends on the scale of conflict or impediment of service delivery.
Due to the finer issues that accompany the process, the department has subjected the process to an on-going pace to allow a thorough scrutiny of, initially, 300 clauses of various pieces of legislation.
