The Department of Cooperative Governance (DCOG) is in the process of reviewing the 2001 Municipal Planning and Performance Management Regulations. The draft amended Regulations have been developed and approved by the CoGTA Minister for public comment. A notice was published by the Government Printing Works on Friday, 20 May 2022 inviting the public to make comment on the proposed amendments to the Regulations. The public can access the document of the draft Regulations on the website of the Department and submit written comments by 30 June 2022.
Section 37 of the Municipal Systems Act, Act 32 of 2000 allows for the Minister responsible for local government to make regulations or issue guidelines to provide for matters in relation to integrated development planning. These regulations are reviewed in terms of Section 120 of the Municipal Systems Act. The review of the Regulations is focused on the Municipal Planning component and is aimed at ensuring that there is greater alignment given the number of government policies and legislation, that have been enacted since 2001 which have implications on integrated development planning processes at a municipal level.
Furthermore, the review of the Regulations seeks to:
- Strengthen the participation of provincial and national sector departments in the IDP processes.
- Improve the alignment of planning and budgeting processes.
- Strengthen the integration of municipal sector plans into the IDP.
- Provide clarity on the IDP review and amendment processes.
- Ensure alignment of requirements for Spatial Development Frameworks between the Municipal Systems Act and the Spatial Planning and Land Use Management Act.
- Institutionalize long-term planning.
- Regulate the prescribed timelines for the development of IDPs.
